Terms of Service

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old and agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

PersistaPro is a fitness coaching platform that connects personal trainers ("Trainers") with their clients ("Clients"). Features include nutrition tracking, goal setting, messaging, progress monitoring, and workout programming.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating your account.
• You may not share your account with any other person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Trial

New trainer accounts receive a 30-day free trial of the Growth plan beginning at account creation. No credit card is required.

• During the trial you have full access to all Growth-tier features at no charge.
• At the end of the 30-day period, your account automatically reverts to the Free plan unless you subscribe to a paid plan.
• Upon reverting, features exclusive to paid tiers become inaccessible. Your data is retained and restored upon subscribing.
• PersistaPro may modify trial duration or eligibility at any time. Changes will not retroactively affect active trials.

5. Subscriptions and Payments

• Paid plans are billed monthly: Starter $29.99/mo · Growth $79.99/mo · Pro $129.99/mo (USD).
• All payments are processed securely by Stripe. We never store your card details.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You may cancel at any time via the billing portal. Access continues through the end of the current billing period. No refunds are issued for partial months.
• Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.
• We reserve the right to change pricing with 30 days' notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Upload false, misleading, or harmful content
• Attempt to access another user's account
• Reverse engineer or copy any part of the Service

7. Health Disclaimer

PersistaPro provides tools for fitness tracking and communication between trainers and clients. We are not a medical service. Nothing on the platform constitutes medical advice. Consult a qualified healthcare professional before starting any fitness or nutrition program.

8. Intellectual Property

All content, branding, and software associated with PersistaPro is owned by Nguyen Capital LLC. You may not copy, reproduce, or distribute any part of the Service without written permission.

9. User Content

You retain ownership of content you submit (messages, photos, data). By submitting content, you grant Nguyen Capital LLC a limited license to store and display it solely for the purpose of operating the Service. We do not sell your content.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time through your account settings.

11. Limitation of Liability

To the maximum extent permitted by law, Nguyen Capital LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, United States. Any disputes shall be resolved in the courts of Arizona.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email.
